What if the other driver has no insurance?
Compensation may still be available under auto insurance coverage know as uninsured motorist insurance (UM) if the other driver has no insurance OR insufficient insurance. How much and under what circumstances UM insurance applies can get tricky. This is definitely an area where an attorney experienced in auto insurance disputes can prove invaluable. Generally UM insurance is available from your own automobile policy unless it was rejected in writing. If the auto insurance company does not have your rejection of UM in writing, then you may have UM. If the UM rejection has not been properly documented, you may also qualify for UM.
You can qualify under somebody else’s UM insurance coverage when occupying their car as a driver or passenger. You can also qualify under certain types of UM insurance (stacking) under the household policies of resident relatives of your household. Often cases have been turned down by other lawyers and Mr. Asencio finds available UM coverage.
What if I am already collecting workers compensation benefits for a work related auto accident?
UM benefits are still available to cover some of the losses that workers compensation does not cover and can be used to defray future medical expenses.
Will UM cover me if the other driver ran me over intentionally?
Yes! UM is one of the few types of insurance which applies even when the other driver intentionally inflicts injury or death.
What if the accident is caused by road debris?
If it can be proved that the road debris came from another car, then UM coverage can apply to cover the injuries or death.
Immediate family members can also seek justice when carelessness results in wrongful death of a loved one. The wrongful death does not have to be the result of a crime. Such damages can include loss of support and services as well as the mental pain and anguish of losing the loved one. However, the time limits to pursue such claims are short (most wrongful death claims must be brought in 2 year or less depending on the circumstances).
